　　Preamble
　　WHEREAStheGovernmentofCanadatogetherwiththeothergovernmentsandtheEuropeanCommunitiesthatparticipatedintheUruguayRoundofMultilateralTradeNegotiationsundertheGeneralAgreementonTariffsandTrade(hereinreferredtoasGATT)haveenteredintotheAgreementEstablishingtheWorldTradeOrganization;
　　WHEREASfree,fairandopentradeisessentialforthefutureoftheCanadianeconomyandforsecuringthecompetitivenessandlong-termsustainabledevelopmentofCanada;
　　WHEREAStradeexpansioncontributestojobcreation,achieveshigherstandardsofliving,offersgreaterchoicesforconsumersandstrengthenstheCanadianeconomicunion;
　　WHEREASthemultilateraltradingsystemofmutuallyagreeduponmarketaccessconditionsandnon-discriminatorytraderulesapplicabletoall,isthecornerstoneofCanadiantradepolicy;
　　WHEREASthetradeagreementsachievedundertheUruguayRoundofMultilateralTradeNegotiationsundertheGATTwillleadtoasignificantlymoreopenandstableinternationaltradingenvironmentforCanadianagriculture,resources,manufacturing,services,technologyandinvestment;
　　WHEREAStheWorldTradeOrganizationwillprovideforintegratedmanagementofthenewandstrengthenedmultilateraltradingsystem,particularlyfortheresolutionoftradedisputes;
　　WHEREAStheWorldTradeOrganization,assuccessortotheGATT,willalsoprovidetheforumforfuturetradenegotiationsaimedatfurtheringtradeliberalizationworld-wideandthedevelopmentofnewglobaltraderules;
　　ANDWHEREASitisnecessary,inordertogiveeffecttotheAgreement,tomakerelatedorconsequentialamendmentstocertainActs;
　　Now,THEREFORE,HerMajesty,byandwiththeadviceandconsentoftheSenateandHouseofCommonsofCanada,enactsasfollows:
　　SHORTTITLE
　　1.Shorttitle
　　ThisActmaybecitedastheWorldTradeOrganizationAgreementImplementationAct.
　　INTERPRETATION
　　2.(1)Definitions
　　InthisAct,
　　"Agreement"meanstheAgreementEstablishingtheWorldTradeOrganization,including
　　(a)theagreementssetoutinAnnexes1A,1B,1C,2and3tothatAgreement,and
　　(b)theagreementssetoutinAnnex4tothatAgreementthathavebeenacceptedbyCanada,
　　allforminganintegralpartoftheFinalActEmbodyingTheResultsOfTheUruguayRoundOfMultilateralTradeNegotiations,signedatMarrakeshonApril15,1994;
　　"federallaw"meansthewholeoranyportionofanyActofParliamentoranyregulation,orderorotherinstrumentissued,madeorestablishedintheexerciseofapowerconferredbyorunderanActofParliament;
　　"Minister",inrespectofanyprovisionofthisAct,meansthememberoftheQueen‘sPrivyCouncilforCanadadesignatedastheMinisterforthepurposesofthatprovisionundersection9;
　　"WorldTradeOrganization"meanstheWorldTradeOrganizationestablishedbyArticleIoftheAgreement;
　　"WTOMember"meansaMemberoftheWorldTradeOrganization.
　　(2)PublicationofAgreement
　　TheAgreementshallbepublishedintheCanadaTreatySeries.
　　PURPOSE

　　ThepurposeofthisActistoimplementtheAgreement.
　　HERMAJESTY
　　4.BindingonHerMajesty
　　ThisActisbindingonHerMajestyinrightofCanada.
　　GENERAL
　　5.ProhibitionofprivatecauseofactionunderPartI
　　Nopersonhasanycauseofactionandnoproceedingsofanykindshallbetaken,withouttheconsentoftheAttorneyGeneralofCanada,toenforceordetermineanyrightorobligationthatisclaimedorarisessolelyunderorbyvirtueofPartIoranyordermadeunderPartI.
　　6.ProhibitionofprivatecauseofactionunderAgreement
　　Nopersonhasanycauseofactionandnoproceedingsofanykindshallbetaken,withouttheconsentoftheAttorneyGeneralofCanada,toenforceordetermineanyrightorobligationthatisclaimedorarisessolelyunderorbyvirtueoftheAgreement.
　　7.(1)Non-applicationofAgreementtowater
　　Forgreatercertainty,nothinginthisActortheAgreement,excepttheCanadianScheduletotheGeneralAgreementonTariffsandTrade1994setoutinAnnex1AtotheAgreement,appliestowater.
　　(2)Definitionof"water"
　　Inthissection,"water"meansnaturalsurfaceandgroundwaterinliquid,gaseousorsolidstate,butdoesnotincludewaterpackagedasabeverageorintanks.
　　PARTIIMPLEMENTATIONOFAGREEMENTGENERALLY
　　ApprovalofAgreement
　　8.Agreementapproved
　　TheAgreementisherebyapproved.
　　DesignationofMinister
　　9.OrderdesignatingMinister
　　TheGovernorinCouncilmay,byorder,designateanymemberoftheQueen‘sPrivyCouncilforCanadatobetheMinisterforthepurposesofanyprovisionofthisAct.
　　WorldTradeOrganization
　　10.MinisterialConference
　　TheGovernorinCouncilmayappointanymemberoftheQueen‘sPrivyCouncilforCanadatobetherepresentativeofCanadainrespectoftheMinisterialConferenceestablishedunderArticleIVoftheAgreement.
　　11.Committeesandbodies
　　TheMinistermayappointanypersontobetherepresentativeofCanadaonanycommittee,councilorbody,otherthantheMinisterialConferencereferredtoinsection10,thatisormaybeestablishedundertheAgreement.
　　12.Paymentofexpenditures
　　TheGovernmentofCanadashallpayitsappropriateshareoftheaggregateofanyexpendituresincurredbyoronbehalfoftheWorldTradeOrganization.
　　Orders
　　13.(1)Ordersresuspensionofconcessions
　　TheGovernorinCouncilmay,forthepurposeofsuspendinginaccordancewiththeAgreementtheapplicationtoaWTOMemberofconcessionsorobligationsofequivalenteffectpursuanttoArticle22oftheUnderstandingonRulesandProceduresGoverningtheSettlementofDisputessetoutinAnnex2totheAgreement,byorder,doanyoneormoreofthefollowing:
　　(a)suspendrightsorprivilegesgrantedbyCanadatothatMemberortogoods,serviceproviders,suppliers,investorsorinvestmentsofthatMemberundertheAgreementoranyfederallaw;
　　(b)modifyorsuspendtheapplicationofanyfederallawwithrespecttothatMemberortogoods,serviceproviders,suppliers,investorsorinvestmentsofthatMember;
　　(c)extendtheapplicationofanyfederallawtothatMemberortogoods,serviceproviders,suppliers,investorsorinvestmentsofthatMember;and
　　(d)takeanyothermeasurethattheGovernorinCouncilconsidersnecessary.
　　(2)Suspensionofconcessionstonon-WTOMembers
　　TheGovernorinCouncilmay,withrespecttoacountrythatisnotaWTOMember,byorder,doanyoneormoreofthefollowing:
　　(a)suspendrightsorprivilegesgrantedbyCanadatothatcountryortogoods,serviceproviders,suppliers,investorsorinvestmentsofthatcountryunderanyfederallaw;
　　(b)modifyorsuspendtheapplicationofanyfederallawwithrespecttothatcountryortogoods,serviceproviders,suppliers,investorsorinvestmentsofthatcountry;
　　(c)extendtheapplicationofanyfederallawtothatcountryortogoods,serviceproviders,suppliers,investorsorinvestmentsofthatcountry;and
　　(d)takeanyothermeasurethattheGovernorinCouncilconsidersnecessary.
　　(3)Periodoforder
　　Unlessrepealed,anordermadeundersubsection(1)or(2)shallhaveeffectforsuchperiodasisspecifiedintheorder.
　　(4)Definitionof"country"
　　Inthissection,"country"includesanystateorseparatecustomsterritorythatmay,undertheAgreement,becomeaWTOMember.
